Conveyancing is the legal process of transferring a property from the seller to you, and it runs from the moment you are ready to make an offer through to settlement day when you get the keys. Knowing the steps in advance takes the mystery out of it and helps you avoid the points where deals go wrong. Here is the process from start to finish.
Before you sign: reviewing the contract
Conveyancing starts before you commit. Once you have found a property, your conveyancer or solicitor reviews the contract of sale and the attached documents, the title, any easements or covenants, the zoning, and the disclosure material the state requires. This is the stage to identify problems while you can still negotiate or walk away. Engaging your conveyancer before you sign, not after, is the single most useful thing you can do.
Signing, deposit and cooling-off
When you and the seller agree, the contract is signed and exchanged, and you pay the deposit, commonly 10% though it can be negotiated. In most states a private-treaty purchase comes with a short cooling-off period. Auction purchases are the exception: they are unconditional with no cooling-off and no finance clause, which is why having formal loan approval before you bid matters so much.
Searches and due diligence
With the contract on foot, your conveyancer orders the searches that confirm what you are buying and surface anything the contract did not. These typically include a title search, council and rates records, any planning or building approvals, and checks for matters like flood overlays or proposed government works affecting the land.
Settlement and after
Settlement is the day the balance of the purchase price is paid, ownership transfers to you, and you receive the keys. Most settlements now happen electronically. Once it is done, the title is registered in your name and the relevant authorities are notified.
